Actually that was settled in court about a year ago.
Because the guy design the Stormtrooper suit and built them, and still holds/ owns the original moulds for the Helmet. He has been given the right to mass produce them as he see fit ands sell them to fans. Though Lucas holds the copyrights to Star Wars, he is not able to dictate how many helmets are made, as he does not own the moulds. He can only stop them being used for anything other than what they are.
If I remember correctly the guy that owns the mould was to pay Lucas a very small % of what he makes form each sales of the helmets.
This was all done in a British. If Lucas is taking him to Court again a guess it a US court. But don’t know if it would hold as the helmets where designs and built in the UK, and fall under UK copyright laws.
