You completely missed the point, though that doesn't render your point invalid either. Someone claimed IP when the IP is actually with the creator of the "universe" that the work is directly derived from. If I was to claim my avatar as my IP then I would be just as culpable, though for slightly different reasons. If I created a character that was directly derivative of Kevin Smith's work and based in his world and claimed IP on the character then I would be doing the same thing as the person who originally complained
